A former lawyer with a disability charged in the Melaka Sessions Court with criminal breach of trust involving more than RM47,000 claims trial.
Tuah Atan, attached with Tuah Hilmy & Hazudin, was accused of misappropriating RM47,431.79 which he was entrusted to handover to Osman Hassan and Zamri Ekhpan.
The 57-year-old from Seremban was alleged to have committed the offence at CIMB Bank Melaka Raya on Sept 20, 2009, while he was still serving as a lawyer.
The offence, under Section 409 of the Penal Code carries a maximum imprisonment of 20 years with whipping and a fine.
Deputy public prosecutor Siti Ruvinna Mohd Rawi urged the court to deny bail but proposed RM60,000 should the court decided to grant bail.
Tuah, who was not represented, pleaded for a lower bail on the grounds that he has a physical disability since birth. He said his disability made it difficult for him to look for a job and he had been unemployed for more than eight years. He added that he is self-supporting and does not rely on assistance from any welfare body.
Judge Meor Sulaiman Ahmad Tarmizi set bail at RM10,000 with one surety and ordered Tuah to report to the Senawang police station every first Saturday of the month. He also set Dec 12 for mention.
