Adib’s family to file an appeal over revision.
The Shah Alam High Court today allowed the bid by an officer handling the inquest into firefighter Muhammad Adib Mohd Kassim’s death to reverse the Coroner’s Court decision on recalling the 24th witness of the proceedings, Hospital Kuala Lumpur (HKL) forensic expert Dr Ahmad Hafizam Hasmi, to testify.
Dr Ahmad conducted the post-mortem on the deceased.
Judge Ab Karim Ab Rahman made the decision after finding that the Shah Alam Coroner’s Court had erred in its decision to reject the inquest handler’s application to recall the expert witness.
“I find that there has been a mistake by the Coroner in that she took into consideration the points (proceedings) will not end (if the 24th witness was recalled).
“I agree with the application by the handler and that only the expert witness, who is also the 24th witness, be recalled to give his explanation and testimony,” he said.
The judge also said Dr Ahmad is needed to explain certain issues raised by another expert, Shahrom Abd Wahib.
He added that the coroner cannot leave out any evidence in making her decision.
Lawyer Kamaruzaman A Wahab, representing Adib’s family, said they would file an appeal over the revision, according to news portal FMT.
