Vivy Yusof, husband to face trial over RM8 million CBT charge

The Sessions Court has fixed a 15-day trial next year for FashionValet Sdn Bhd founders Datin Vivy Sofinas Yusof, known as Vivy, and her husband Datuk Fadzarudin Shah Anuar, over charges of criminal breach of trust (CBT) involving RM8 million in investment funds from Khazanah Nasional Berhad and Permodalan Nasional Berhad (PNB).

Judge Rosli Ahmad set the trial dates for 13–17 April, 18–22 May, and 8–12 June 2026.
“The trial will run for 15 days, and the court has set the next case mention for 27 October,” said Rosli.

Earlier, Deputy Public Prosecutor Datuk Wan Shaharuddin Wan Ladin requested the court to fix the dates agreed upon by both the prosecution and the defence. Lawyer M Athimulan is representing the couple.

Wan Shaharuddin informed the court that 26 witnesses will be called to testify.

The accused, both aged 37, were not present as their attendance had been exempted.

On 5 December last year, Vivy and Fadzarudin pleaded not guilty to a charge of committing CBT in their capacity as directors of FashionValet Sdn Bhd. They were accused of misappropriating RM8 million entrusted to them by Khazanah and PNB by transferring the funds from FashionValet’s company account to 30 Maple Sdn Bhd without approval from the board of directors.

The offence was allegedly committed on 21 August 2018 at Public Bank Berhad, Bukit Damansara Branch, 36–40 Medan Setia 2, Plaza Damansara, Bukit Damansara.

The charge, under Section 409 of the Penal Code read together with Section 34, carries a penalty of two to 20 years’ imprisonment, whipping, and a fine upon conviction.

The couple also pleaded not guilty to an alternative charge of jointly and dishonestly misusing RM8 million belonging to FashionValet Sdn Bhd. This charge, under Section 403 of the Penal Code read together with Section 34, provides for a jail term of six months to five years, whipping, and a fine upon conviction.
