Two Cases of Uncles Sexually Violating Nieces, a Victim Now Pregnant

One suspect preyed on the victim when she was only 10, while the other is old enough to be the victim’s grandfather yet she had consensual sex with him.

A 35-year-old labourer from Paya Mengkuang pleaded not guilty at the magistrate’s court in Melaka yesterday to two counts of sexually assaulting his 12-year-old niece.

He was first charged with using criminal force against the girl by groping her breasts at a house in Taman Rambai Jaya, Tanjung Minyak, at about 1.30pm on May 2016.

If convicted, the accused faces imprisonment of up to 10 years, or a fine or whipping, or any two of such punishments under Section 354 of the Penal Code for assaulting or use of criminal force to a person with the intent to outrage modesty.

He was also charged with committing outrage of decency of the same victim by asking her to hold his private part, at the same date, time and location. If convicted, he faces a maximum jail sentence of up to two years under Section 377D of the Penal Code, if convicted.

Deputy Public Prosecutor N Sivashangari proposed that a RM8,000 bail be set along with several conditions, including prohibiting the accused from harassing the victim.

However, the accused’s lawyer, G Kumaresan, urged the court to lower the bail considering that his client is supporting a wife and parents, aside from earning a low monthly income of RM900.

Magistrate Mohd Firdaus Salleh set bail at RM4,000 with a surety and fixed Nov 16 for mention of the case.

Consensual sex with aged uncle leads to teenage schoolgirl being 15 weeks pregnant 

In Mukah, Sarawak, police arrested a 65-year-old man for allegedly raping his niece, who is now 15 weeks pregnant.

The case came to light when the secondary school student consulted a female doctor at the hospital for not having her period for the past two months, The Star reported.

“A medical observation by the doctor revealed that the girl is now 15 weeks pregnant,” said Mukah OCPD Dept Supt Jimmy Panyau.

The doctor lodged a police report at 5pm on Monday.

According to the police, the victim revealed that she has been having consensual sex with the suspect since April this year.

“The girl could not remember how many times they had sex but they had sex in his car and at two hotels here,” Jimmy said.

He added that the sex is still an offence under Section 376 of the Penal Code although it was consensual.

The suspect was arrested on Monday and was remanded for seven days until Oct 17.
