No “locus standi” to file the case.

The High Court here today dismissed the application for a review on the acquittal of former Chief Minister Lim Guan Eng and businesswoman Phang Li Koon.
Judge Datuk Hadhariah Syed Ismail in dismissing the case, said the applicant, Muhsin Abdul Latheef, does not have “locus standi” to file the case.
“The applicant is neither the aggrieved party nor is he involved in any part of the proceedings, thus he does not have any interest in filing the application,” said Hadhariah on Friday (Oct 12).
She said Section 278 of the Criminal Procedure Code also states that no court, other than the High Court having once recorded its judgement, shall alter or review the same.
Muhsin filed an application for a review of the acquittal on Sept 19.
The High Court granted a discharge amounting to an acquittal to Lim and Phang on Sept 3, over their corruption charges two years ago.
Lim was represented by Ramkarpal Singh and RSN Rayer, while Phang was represented by Datuk V Sithambaram. Mushin was represented by lawyer J Gunamalar. – The Star
