Najib Fails in Bid to Strike out 1MDB Audit-Tampering Case

Najib’s application did not meet the high threshold required to set aside or quash the charge against him.

The Kuala Lumpur High Court today dismissed Najib Razak’s application to strike out the charge of tampering with the 1Malaysia Development Bhd (1MDB) final audit report.

He is charged jointly with former 1MDB chief Arul Kanda Kandasamy.

Judge Mohamed Zaini Mazlan made the decision after finding that the charge against Najib, 67, was not misleading as alleged by the former prime minister.

“The grounds given by the applicant (Najib) should only be considered at the end of the prosecution case. It’s premature for the court to consider the grounds (to strike out charge) at this stage,” he said.

The judge also said such application should only be allowed in the rarest of circumstances, where there was a miscarriage of justice.
