Danial Tan Abdullah, who was sentenced to 12 months in prison for smashing the windscreen of a car recently, has been released after spending just six days in jail.
According to Sinar Harian, the Petaling Jaya Magistrate’s Court allowed the sentence to be postponed.
The Malay daily reported that the hearing took place before Magistrate Nur Shahira Abdul Salim on Friday (June 7).
The court set bail at RM6,000 and ordered Danial to report to a nearby police station twice a month.
When questioned in court about his action, Danial said the vehicle nearly hit him twice, causing him to confront the driver.
“However, he made an obscene gesture at me,” he added.
Danial told the court he was remorseful for his actions.
During mitigation, his counsel Nur Rafiuddin Naswari pleaded for a fine rather than imprisonment as his client was the sole breadwinner for his family.
She added that it was her client’s first offence, and said that it was a spontaneous one.
Nur Rafiuddin added that Danial had been criticised by the public when his identification card, work address and home address were shared on social media.
However, Deputy Public Prosecutor Muhammad Hairuliqram Hairuddin called for a stern sentence that would serve as a lesson to both the accused and the public as road rage cases happened frequently.
Dashcam footage taken of the incident went viral on social media after the incident, prompting many to condemn the incident and ask for justice to be served.
