The Sessions Court today dismissed a stay of execution Rumah Bonda founder Siti Bainun Ahd Razali sought over her 12-year prison sentence for neglecting and abusing a 13-year-old girl with Down Syndrome known as Bella two years ago.
Sessions Court Judge Izralizam Sanusi said he found no reason to postpone the sentence meted out earlier, since the accused failed to provide a valid reason to support her application for a suspension of his ruling.
He said her lawyer’s reason that a notice of appeal has been filed with the High Court did not constitute “special circumstances.”
“In my view, the factors argued by the accused’s counsel has failed to show extraordinary reasoning.
“Therefore, there is no reason for me to further delay the execution of the jail sentence imposed as no special circumstances have been shown to justify the application.
“Justice will now be truly served by way of having the punishment carried out immediately. The court orders for the accused to serve her sentence immediately,” he said.
Earlier, Izralizam sentenced Siti Bainun to 10 years’ imprisonment for the first charge, and 12 years for the second charge, on top of serving 200 hours of community service after her prison sentence.
The jail sentences are to run concurrently from the date of her conviction today, meaning Siti Bainun only has to serve 12 years at Kajang Prison.
Siti Bainun was accused of committing the offence at a condominium unit in Wangsa Maju between February and June 2021.
The charges were framed under Section 31(1)(a) of the Children’s Act 2001 which carries a maximum of 20 years’ imprisonment or a fine of RM50,000 or both if convicted.
She was ordered to enter her defence last November 24. – MMO
