Yang Amat Berbahagia Tun Tengku Maimun Tuan Mat,

As Tun prepares to transition into a well-deserved retirement this July, after serving as the Chief Justice of Malaysia with unwavering dedication, we, the people of Malaysia, would like to extend our deepest appreciation for your exemplary service in upholding justice, integrity, and the supremacy of the rule of law. Your leadership has strengthened public confidence in the nation’s judiciary, especially in the face of significant challenges.

However, as Tun approaches retirement, the nation finds itself in a critical juncture in its legal and political history. The final decision in the SRC International case, involving substantial fines, house detention, and a pardon decision by the former Yang di-Pertuan Agong, has sparked widespread reactions and debates among the people. We acknowledge that these developments, occurring just prior to your retirement, may leave a lasting impact. Nonetheless, Tun’s steadfastness and courage in championing the principles of justice will forever be remembered as a model for the nation.

This moment also underscores the urgent need to protect judicial independence and to strengthen mechanisms that ensure the Constitution remains the supreme law of the land. Therefore, we respectfully propose that Tun considers leading the effort to establish a Constitutional Court in Malaysia, similar to those in Germany, India, and South Korea. This court would serve as a critical institution to defend the Constitution, resolve significant constitutional issues, and maintain the balance of power between the executive, legislative, and judicial branches.

Malaysia is now at a crossroads. This is the time for all parties—leaders, Members of Parliament, and civil servants—to reaffirm their oath of office. That oath is not merely ceremonial but a solemn responsibility to uphold the Constitution, ensure accountability, and prioritize the welfare of the people and the nation.

As a highly respected figure in the judicial world, Tun’s voice and leadership are essential in guiding Malaysians, legal professionals, and policymakers toward meaningful reforms. Establishing a Constitutional Court would not only fortify the rule of law but also provide a transparent and fair platform to resolve disputes.

We hope that Tun will continue to be a source of inspiration to the nation, moving forward as a symbol of justice and integrity. Tun’s legacy goes beyond the role of Chief Justice; it is a legacy of courage, justice, and dedication to the principles of democracy.
