Pakatan Harapan’s candidate for Rantau, Dr S Streram, is suing Election Commission (EC) returning officer Amino Agos Suyub and the EC for misfeasance in public office.
Dr Streram, 63, filed suit at the High Court Registry through his lawyer, Haniff Khatri, on Monday (May 7) with Amino Agos and the EC named as defendants.
In his statement of claim, he said he paid his nomination deposit of RM5,000 and RM3,000 for his campaign material deposit at the EC office in Seremban, Negri Sembilan, on April 25.
His statement claims that at no time did the EC inform him that name tags or entry passes were needed for the candidate and his representatives to enter the nomination hall on April 28.
The plaintiff alleged that at 4.30pm on April 27, he was informed by a friend that he needed to collect the tags and passes from the Rembau District Office but he only reached the office at 6.45pm and it was already closed.
He said a female officer told him that he could collect the tags and passes early the next morning before submitting his nomination form on April
Dr Streram alleged that at 9am, he was not allowed to enter the nomination hall and at 9.20am, a proposer came out of the hall and took his nomination form. The proposer informed an EC officer that the plaintiff was outside the hall and could not enter as he did not have his name tag and entry
He said at 9.40am, the Paroi candidate informed him that his nomination form was rejected by the EC as the proposer and seconder were not present in the hall and was further told that Barisan Nasional candidate won the seat unopposed.
The plaintiff is seeking special damages; RM5mil in general damages and exemplary damages of RM2.6mil or any amount estimated by the court; costs or any reliefs and further orders deemed fair by the court. – The Star
